Terms of service
1. Overview
This website, undercoverfitnessco.com (the "Store"), is operated by Undercover Fitness ("we", "us", "our"). By visiting the Store or buying from us, you agree to these Terms of Service ("Terms"), together with our Privacy Policy, Refund Policy and Shipping Policy. If you don't agree, please don't use the Store. The Store is hosted on Shopify.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. If you're younger, you may use the Store only with the involvement and permission of a parent or guardian.
3. Health and safety: please read
- Our products are general fitness equipment and accessories. They are not medical devices and are not intended to diagnose, treat, cure or prevent any condition. Nothing on the Store is medical advice.
- Talk to a doctor before using weighted or resistance products if you have, or have had, any joint, back, heart, blood-pressure, jaw (TMJ) or other medical condition, are pregnant, or are recovering from an injury.
- Start with the lightest setting, build up gradually and follow the product instructions. Stop immediately if you feel pain, dizziness, numbness, shortness of breath or jaw pain or clicking.
- Don't wear weighted products while swimming, sleeping, driving or doing anything where restricted movement could be unsafe. Keep products away from young children.
- Results vary from person to person and depend on your training, diet, rest and consistency. We don't promise any specific results.
- You use our products at your own risk, and you're responsible for using them sensibly and safely.
4. Products and descriptions
We try to describe and photograph our products accurately, but colours, sizes and finishes can vary slightly, and we don't guarantee that every description is error-free. We may change or discontinue products at any time.
5. Prices and payment
Prices are in US dollars and may change without notice. If a product is listed at an incorrect price because of an error, we may cancel orders placed at that price and refund you in full. Payment is processed securely by Shopify and its payment partners. We don't store your full card details.
6. Orders
Placing an order is an offer to buy. We may refuse or cancel an order, for example if an item is unavailable, if there's a pricing error or if we suspect fraud. If we cancel after you've paid, we'll refund you in full.
7. Shipping, returns and refunds
Shipping is covered by our Shipping Policy, and returns and refunds by our Refund Policy.
8. Digital program
The Undercover Training Arc program is provided for your personal use only. You may not copy, resell, share your access or redistribute its content. The program provides general fitness information, and section 3 applies to it as well.
9. Reviews and content you send us
If you post a review or send us photos, videos or feedback, you confirm that the content is yours and lawful, and you give us permission to use, reproduce and display it to promote Undercover Fitness, with credit where appropriate. We may remove content at our discretion.
10. Intellectual property
All content on the Store, including the Undercover Fitness name and logo, text, graphics, images and program materials, belongs to us or our licensors. You may not use it without our written permission.
11. Prohibited use
You agree not to use the Store for anything unlawful, to interfere with its security or operation, to scrape or copy it for commercial purposes, or to place fraudulent orders.
12. Disclaimer of warranties
Except as expressly stated in our policies, and to the fullest extent permitted by law, the Store and our products are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability and fitness for a particular purpose. Some jurisdictions don't allow certain warranty exclusions, so some of these may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Undercover Fitness will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Store or our products. Our total liability for any claim relating to a product is limited to the amount you paid for that product. Nothing in these Terms limits liability that cannot legally be limited.
14. Indemnification
You agree to indemnify and hold harmless Undercover Fitness from claims arising out of your breach of these Terms or your misuse of our products.
15. Governing law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.
16. Changes
We may update these Terms from time to time. The "Last updated" date shows the latest version. Continuing to use the Store after changes means you accept them.
